JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Bahadurganj P.S. Case No. 173/2017, registered for the offence punishable under Sections 457, 380 of the Indian Penal Code. Rs. 11563/- is said to have been stolen from the Branch of Village Financial Services Pvt. Ltd. by breaking the lock of the gate by some of the unknown miscreants in the night. It is submitted by the learned counsel for the petitioner that petitioner is neither named in the F.I.R. nor any incriminating article is said to have been recovered from the conscious possession of the petitioner. Two currency notes of denomination of 500 each are said to have been recovered from the pant of the petitioner, but the said note was not put on T.I.P. Said note is of

Patna High Court Cr.Misc. No.53724 of 2017 (2) dt.09-11-2017 2/2 the petitioner. Confessional statement recorded by the Police during the course of investigation has no evidentiary value in the eye of law.

Considering the facts and circumstances of the case, the above named petitioner, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Bahadurganj P.S. Case No. 173/2017.
