The petitioner apprehends his arrest in connection with Kanti P.S. Case No.351 of 2019 registered under Sections 457 and 380 of the Indian Penal Code.

The accusation is that the informant along with his son went to Dhanbad, asking the petitioner to look after his house but the petitioner let out the house of the informant on rent without giving information to the informant. When the informant received information from his neighbour in this regard, then the informant returned to his house on 13.05.2019 and found the households articles of his house in scattered condition and also found that the ornaments and clothes, kept in the box and attachee, were missing.

Learned counsel for the petitioner submits that, in fact, the informant and his son left the house for Dhanbad, giving instruction to the petitioner to look after his house but, unfortunately, in the night, theft was committed in the house of the informant. The informant raised suspicion against the petitioner having hand in committing the theft in his house. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, West Muzaffarpur, in connection with Kanti P.S. Case No.351 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
