JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-10-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Buxar (Ind) P.S. Case No. 110-16 registered under Section 304(B)/34 of the Indian Penal Code.

The accusation is of killing of daughter of the informant by her husband and in-laws' due to non-fulfillment of demand of dowry by pressing her neck.

Learned counsel appearing on behalf of the petitioner submits that petitioner, who happens to be mother-inlaw of the deceased, daughter of the informant, has falsely been implicated in this case. In fact, the deceased was under depression due to death of her baby within one year and thereafter, she was

Patna High Court Cr.Misc. No.44375 of 2016 (2) dt.22-10-2016 2/2 under treatment regarding her depression. In depression, she committed suicide. The information was given to the informant regarding committing suicide by his daughter and informant came and participated in last ceremony. But the informant with ulterior motive has lodged the present case with false allegation of demand of dowry and causing death by his daughter due to non-fulfillment of demand. Further submission is that husband of the deceased, Santosh Kumar Singh is already in custody.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Buxar in connection with Buxar (Ind.) P.S. Case No. 110-16, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
