The petitioner is in custody in connection with Shahkund P.S.Case No.108 of 2017 registered for an offence under Section 395 of IPC.

It is alleged that on 12.06.2017 some miscreants committed highway robbery in a bus which was carrying a Barat Party.

The learned counsel for the petitioner submits that the petitioner is alleged to be a co-passenger who was not robbed by the miscreants. The name of this petitioner appeared in a confession of co-accused Karu. The said Karu Singh who disclosed the name of four persons have been allowed bail. The

Patna High Court Cr.Misc. No.60459 of 2017 (2) dt.19-12-2017 2/2 other co-accused whose name appeared in the confessional statement have also been allowed bail by the court below. One of the co-accused Ashok Das @ Abhay Das has also been allowed bail in Cr.Misc.No.59149 of 2017. This petitioner has clean antecedent and is in custody since 14.06.2017. The case of this petitioner stands on better footing and so he deserves bail. The learned APP opposed the submission.

Considering the case of this petitioner on similar footing facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM, Bhagalpur in connection with Shahkund P.S.Case No.108 of 2017.
