JUSTICE JYOTI SARAN ORAL ORDER 29-04-2015 The writ petition was filed by the petitioner with a request of disposal of their representations in respect of grant of scholarship under the scheme 'Bihar Scholarship, 2014' introduced by the Government of Bihar. It was the contention of the petitioner that he filed his application on-line for grant of scholarship for the academic sessions 2010-11 and 2011-12 before the District Welfare Officer and which scholarship was paid to the institution but in so far as the academic session 201213 is concerned, the scholarship has not been paid. Patna High Court MJC No.4152 of 2014 (3) dt.29-04-2015 disposed of with a liberty to the petitioner to file a fresh representation before the concerned authority of the Government of Bihar who were required to dispose of the same within a month from the date of receipt/production of a copy of the order. This contempt application was filed complaining of non-compliance and the petitioner encloses a representation which is stated to have been filed before the Secretary and the Deputy Secretary of the Backward Class Welfare Department and the District Welfare Officer, Bhojpur at Ara on 16.7.2014, following the order passed in the writ petition. A show cause has been filed on behalf of the opposite party nos.

2 and 4 and while enclosing an order passed by the Deputy Secretary, Backward Class and Extremely Backward Class Welfare Department, Government of Bihar vide letter dated 14.1.2015 addressed to the petitioner it is stated that the claim of the petitioner has been rejected on account of not having been submitted within the time stipulated.

Patna High Court MJC No.4152 of 2014 (3) dt.29-04-2015 opinion, no case for contempt is made out and this application is accordingly disposed of.

The petitioner if so advised, may question the order of rejection passed by the Deputy Secretary placed at Annexure-A to the show cause by filing an appropriate application before the appropriate forum.
