The petitioners apprehend their arrest in Pakaridayal P.S. Case No. 51/2016, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code and Section 27of the Arms Act.

The informant alleged that he was in queue for casting his vote. Chhedi Singh petitioner no. 1 came there with firing his gun and called his supporters. Many persons having armed with different weapons came there. Thereafter people who were in queue started fleeing away. Rana Singh son of Chhedi Singh assaulted the informant on his head with stick. The informant also

Learned counsel for the petitioners submits that only one person was injured. Petitioners are not the assailants. Similarly situated co-accused namely, Devendra Prasad Singh, Abhimanyu Kumar Singh, Ajit Singh and Ajay Pandey have already been granted anticipatory bail by this court.

Considering the facts aforesaid and the fact that the petitioners are not the assailants and they are member of the mob and similarly situated co-accused have already been enlarged on anticipatory bail, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 5th, Motihari, East Champaran in connection with Pakaridayal P.S. Case No. 51/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
