JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-01-2019 This application, for grant of anticipatory bail, arises out of Biraul P.S. Case No. 43 of 2016, disclosing offences under Sections 341, 323, 379, 354, 308, 504 and 34 of the Indian Penal Code.

Allegation against the petitioner is that he assaulted the informant by means of iron rod causing injury to her. Submission of learned counsel for the petitioner is that the an altercation took place between the informant and petitioner on a petty dispute of throwing of garbage. Further submission is that there is case and counter case and although it is alleged that petitioner assaulted the informant by means of iron rod, however, injury caused to the informant by the said assault was found to be simple in nature.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Six Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Biraul, Darbhanga, in connection with Biraul P.S. Case No. 43 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is further subject to the condition that he will cooperate in investigation of the case and will appear as and when required by the police, except on showing genuine reasons (Vinod Kumar Sinha, J) sunilkumar/- U T
