The petitioner apprehends his arrest in (Nawada) Mahila P.S. Case No.23 of 2018 registered under Sections 323, 341, 376, 420, 504 and 34 of the Indian Penal Code. The informant herself alleged that she was working as maid in the house of Dr. D.K.Sinha along with the petitioner and they developed relationship. The petitioner is said to have established physical relation with the informant. The informant further alleged that she also contributed in purchasing the land and construction of the clinic but later on, the petitioner and his wife assaulted the informant.

The learned counsel for the petitioner submits that the informant was partner in the clinic of the petitioner. Some dispute arose due to share of benefits and for that, this false case

Patna High Court Cr.Misc. No.74675 of 2018(2) dt.20-12-2018 2/2 has been lodged.

From perusal of F.I.R. itself, it appears that victim is a major and consenting party. She was in living relation with the petitioner for many years.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Nawada in connection with Mahila P.S. Case No.23 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
