The petitioner is apprehending his arrest in connection with Chhauradano P.S. Case No. 219 of 2018 for the offence under Section 30 (a) of Bihar Prohibition and Excise Act 2016. Learned counsel appearing on behalf of the petitioner submits that petitioner has no criminal antecedent. He further submits that petitioner is not involved in business of liquor. Nothing was recovered from the house or constructive possession of the petitioner. He further submits that mandatory requirement of Provision of Section 100 of the Cr.P.C. was not followed.

Considering the fact that the petitioner has no criminal
