The petitioner seeks bail in Shahpur P.S. Case No. 91 of 2019, instituted for the offence under Section(s) 394, 302 and 201 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery of alleged pick-up van from possession of the petitioner. He further submits that name of petitioner has come in the confessional statement of co-accused Manjhil Yadav. The police thereafter arrested the petitioner and recorded his confessional statement. Petitioner is in custody since 24.4.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of

Patna High Court CR. MISC. No.51874 of 2019(2) dt.26-08-2019 2/2 the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhojpur, Ara, in connection with Shahpur P.S.
