JUSTICE BIRENDRA KUMAR ORAL ORDER 12-12-2017 Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code. The FIR is against unknown. The petitioner was arrested in connection with some other case and the petitioner, allegedly, confessed before the police regarding his involvement in the present case. Thereafter, the petitioner was remanded in this case also.
Submission is that nothing was recovered from possession of the petitioner. The petitioner is in custody since 04.07.2017 but he was not put on TIP. Investigation is complete and the petitioner is ready to cooperate with the trial. Considering the aforesaid facts, let the petitioner,
Patna High Court Cr.Misc. No.58317 of 2017 (2) dt.12-12-2017 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ramgarh Police Station Case No. 85 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
