JUSTICE RAKESH KUMAR ORAL ORDER 20-09-2016 Heard Sri Anupa Nand Jha, learned counsel for the petitioners and Sri Navin Kumar Pandey, learned A.P.P. Three petitioners, who are named with specific accusation in Shahkund (Sajour) P.S. Case No. 99 of 2014 registered for offence under section 302 , 34 of the Indian Penal Code , have approached this court in the month of September, 2016 for grant of anticipatory bail in a case in which F.I.R. was lodged on 19/6/2014 with specific accusation of murder. It was submitted by learned counsel for the petitioners that petitioners have falsely been implicated. Petitioners are residing outside. On aforesaid grounds a prayer has been made for grant of anticipatory bail.

No.39071 of 2016 (2) dt.20-09-2016 2/2 However after going through the F.I.R. it is evident that there is serious accusation against the petitioners in which one 'Sant' was done to death brutally by the accused persons including the petitioners. The prayer for grant of anticipatory bail stands rejected.

While dismissing the prayer for grant of anticipatory bail it is desirable to direct the concerned Superintendent Of Police to examine the matter as to under what circumstances if there is specific accusation against the petitioners how they are still at large.

Let a copy of this order be sent to the concerned Superintendent Of Police.
