KUMAR ORAL ORDER 15-01-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks regular bail in connection with Sessions Trial No. 400 of 2017 arising out of Chandradeep P. S. Case No. 43 of 2017 registered for offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act. Allegation against the petitioner is that he is order giver for firing on the father of the informant. No specific overt act has been alleged against the petitioner other than as stated. Learned counsel for the petitioner submits that the allegation of firing is against one Nitish Kumar and other Upendra Yadav, who fired on the father of the informant and he died on the spot. It has further been stated that F.I.R. has been registered

Patna High Court Cr.Misc. No.59315 of 2017 (3) dt.15-01-2018 2/2 after 24 hours after the occurrence and there is a case and counter case between the parties.

It has been submitted that the petitioner has clean antecedent and the petitioner is in custody since 01.06.2017. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- II, Jamui in connection with Sessions Trial No. 400 of 2017 arising out of Chandradeep P.S.Case No. 43 of 2017.
