The petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 29 of 2016 registered under Sections 406 and 420/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the supplementary affidavit (Annxure-3) filed on 01.09.2016 on behalf of the petitioner that husband of the informant entered into an agreement with co-accused Sujit Kumar and sold the land, for which consideration money has been paid to the husband of the informant, upon which the petitioner made his signature as witness. In fact, this is a case of civil dispute and this petitioner

Patna High Court Cr.Misc. No.36847 of 2016 (3) dt.13-01-2017 2/2 has been implicated in this case with false allegation. Further submission is that petitioner has got no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Gaya in connection with Muffasil P.S. Case No. 29 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
