====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY KUMAR ORAL ORDER 17-12-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehend his arrest in connection with Buxar (Town) P.S.Case No. 372 of 2018, registered for the alleged offenses punishable under Sections 406, 420 and 120 (b) of the Indian Penal Code.

The informant has alleged that this petitioner in collusion with other co-accused cheated him. They took an amount of Rupees ten lacs fifty thousand and executed sale deed in her favour on 26.02.2016. The informant was neither put in possession thereof nor they returned the money and thereby cheated and committed breach of trust.

It has been submitted that the petitioner had or has no concern with the sale deed in question. He is one of the attesting witness to the sale deed and so no offence against this petitioner is made out.

Patna High Court Cr.Misc. No.74112 of 2018(2) dt.17-12-2018 2/2 Considering the facts and circumstances of the case, the prayer of anticipatory bail of the petitioner is allowed. The petitioner is the event of arrest or surrender before the Court below within a period of six weeks from today, is directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (Town) P.S. Case No. 372 of 2018 and also subject to the conditions that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
