The petitioner is in custody in connection with Magadh University P.S. Case No. 127 of 2012, a case under Section 395 of the Indian Penal Code, pending in the Court of Chief Judicial Magistrate, Gaya.

The F.I.R. of the occurrence of dacoity is against unknown. However, a mobile phone was recovered which was of Rekha Devi, who disclosed to the police that she had given the mobile phone to the petitioner to be used that much is the material against the petitioner and petitioner is in custody since 25.07.2017. Petitioner has got such type of allegation as per para-3 of the petition.

Patna High Court Cr.Misc. No.57816 of 2017 (3) dt.05-01-2018 P2/ Considering the entire facts, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail is refused. However, the petitioner may renew the prayer for bail after six months from today if the trial is not concluded within time. The learned trial Court is directed to expedite the trial.
