JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 20-06-2023 At the outset, learned counsel for the petitioner seeks permission to withdraw this anticipatory bail petition in respect of petitioner no.1, Ranjeet Kumar @ Ranjeet Kumar Sah as he has already been apprehended by the police during pendency of this bail petition.
Permission is granted.
Accordingly, this anticipatory bail petition is dismissed as withdrawn so far as petitioner no.1, Ranjeet Kumar @ Ranjeet Kumar Sah is concerned.
Now, the instant anticipatory bail petition survives only against petitioner no.2, Prem Kumar.

Petitioner, Prem Kumar apprehends his arrest in connection with Samastipur Muffasil P.S. Case No.280 of 2022, registered for the offences punishable under Sections 419, 420, 467, 468, 471 and 120B/34 of the Indian Penal Code. The allegation against the petitioner is that he was making obstruction in construction of the informant's house and demanded Rs.4-5 lakhs from the informant. The matter was taken to the Janta Darbar and both the parties have produced papers of land. The Revenue Officer made inquiry and paper produced by the petitioner was found forged and fabricated. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail petition.
It is further submitted that the document produced by the petitioner is of the year 1924. Learned APP for the State as well as learned counsel for the informant opposed the prayer for grant of anticipatory bail to the petitioner by submitting that the petitioner has produced forged and fabricated document in the Janta Darbar.

No.61090 of 2022(7) dt.20-06-2023 3/3 the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Samastipur in connection with Samastipur Muffasil P.S. Case No.280 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
