JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 03.12.2014 in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

It is alleged that the informant, after withdrawing Rs. 1,76,000/- from Bank, was coming to the house which was snatched away by some unknown persons. The F.I.R. was lodged against five unknown persons.

It is submitted by the learned counsel for the petitioner that the name of the petitioner sprang up during investigation and statements have been made in para-10 and 11 of the petition that neither recovery has been made from the petitioner nor he was put on Test Identification Parade.

Considering the facts that the petitioner has not been

No.8238 of 2015 (2) dt.04-03-2015 2/2 put on Test Identification Parade, let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Nawanagar P.S. Case No. 142 of 2014.

Since the petitioner is accused in three other cases, learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for two consecutive occasions or gets involved in some serious nature of offence.
