Petitioners apprehend their arrest in a case registered for the offence punishable under Section 306/ 34 of the Indian Penal Code.

As per the prosecution case, husband of the informant committed suicide because of pressure and torture committed by these petitioners to vacate the shop in question. Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. It is further submitted that these petitioners never put any pressure to vacate the shop in question. As a matter of fact

No.66621 of 2021(7) dt.02-08-2022 2/2 the shop in question was vacated on 29.04.2021 whereas the deceased committed suicide on 12.06.2021, that is, after one and half months and suicide was not proximate to alleged pressure. Moreover, asking to vacate the shop can not be said to an act of abetment. Petitioners have got clean antecedent. Learned counsel appearing for the Informant opposes the prayer for anticipatory bail and submits that in the suicide note the deceased has categorically stated that these petitioners are responsible for his suicide. The video of suicide was also made viral on social media.

Considering the facts of the case and clean antecedent of the petitioners, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial MagistrateIV, Patna in connection with Sri Krishnapuri PS case No. 135/ 2021, subject to conditions laid down u/s 438(2) of the Cr.
