The petitioners apprehend their arrest in a case registered for offences punishable under Sections 341, 323, 379, 406, 420, 465 and 506/34 of the Indian Penal Code. As per allegation the brother and nephew of the complainant have sold the land which falls in the share of the complainant. So far the petitioners are concerned they stood as witnesses to the sale deed.

It is contended that the purchaser has already been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 17.9.2016 passed in Cr. Misc. No. 36576 of 2016.

No.37940 of 2016 (2) dt.23-09-2016 2/2 Having regard to the facts and circumstances, let the above named petitioners be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Complaint Case No. 279C/2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Madhepura subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
