The petitioner seeks bail in a case registered for offences punishable under Section 47 (A) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 252 litres foreign liquor was recovered from a Boloro vehicle. The Khalasi who was apprehended from the spot has named the petitioner as the recipient of the illicit liquor at the command of the owner of the vehicle. Petitioner claims that he is having clean antecedent and is in custody since 14.09.2017. Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten
Patna High Court Cr.Misc. No.52586 of 2017(2) dt.09-11-2017 2/2 Thousand) with two sureties of the like amount each to the satisfaction of 2nd Addl. Sessions Judge, Jamui in connection with Chandradeep P. S. Case No. 51 of 2016. Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
