JUSTICE ARUN KUMAR ORAL ORDER 19-12-2017 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Jehanabad P.S.Case No. 22 of 2016 registered under Sections 302, 323, 324, 341 and 504/34 of the Indian penal Code. Allegation in brief is that due to land dispute, all accused persons came to the house of the informant and assaulted his brother as a result victim died.

Learned counsel for the petitioner submits that there is no specific allegation against the petitioner and other co-accused Madhir Bind and Rustam Kumar @ Rustam Bind have been admitted to bail by a co-ordinate Bench of this Court vide order dated 09.08.2016 in Cr. Misc. No. 25166 of 2016 and order dated 09.12.2016 in Cr. Misc. No. 32776 of 2016 and this petitioner is in custody since 08.09.2018; moreover, charge sheet too has been

Having considered the aforesaid facts and circumstances, the petitioner, namely, Nepali Bind is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned C.J.M., Jehanabad in connection with Jehanabad P.S. Case No. 22 of 2016.
