JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2019 This is an application for grant of anticipatory bail in connection with Samastipur Mufassil P.S. Case No. 546 of 2018, disclosing offences under Sections 547, 341, 354, 504, 34 of the Indian Penal Code and Section 37(C) of Bihar Prohibition and Excise Act, 2016.

Allegation as per F.I.R. against the petitioner and other accused persons is that they have entered inside the house of the informant with drunken condition and misbehaved with the daughter and daughter-in-law of the informant and try to outrage their modesty and there is also allegation of abusing and on Hulla two persons were arrested and petitioner succeeded in fleeing away.

Submission of learned counsel for the petitioner is

Patna High Court Cr.Misc. No.78448 of 2018(3) dt.09-01-2019 2/2 that the petitioner has falsely been implicated in this case due to village rivalry and no specific allegation has been attributed against the petitioner.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court, if possible on the same day.

Accordingly, this application is dismissed.
