The petitioner seeks pre-arrest bail in connection with Paroo P.S. Case No. 347/2018 registered under Section 379/411 of the Indian Penal Code.

The accusation is that on seeing the three persons on motorcycle the informant and other police personnel tried to check the motorcycle but both flee away leaving the motorcycle. Local people identified to one as Vijay Bhagat (petitioner). Learned counsel appearing on behalf of the petitioner submits that petitioner has no criminal antecedent and he was not apprehended on spot, rather his name has surfaced on the basis of disclosure of villager mere on suspicion.

Case No. 347 of 2018 shall be released on bail on furnishing bail bond of Rs. 10,000/- (rupees then thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-3rd, (West), Muzaffarpur or the successor Court subject to the conditions as laid down under Section 438 (2) of the Criminal Procedure Code.
