2. In the present case, the petitioner seeks bail in connection with Bhimnagar P.S. Case No. 32 of 2025 dated 17.05.2025, registered for the offences punishable under Sections 140(3), 143 and 144 read with Section 3(5) of the B.N.S., 2023.
3. As per the prosecution case, the petitioner and co-accused Mukesh Kumar were found involved in human trafficking and were apprehended while they were taking a young girl to Nepal giving her inducement of securing a job for her.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely

From the FIR, it is apparent that the petitioner has not committed any offence and has not kidnapped the victim girl. The petitioner had not been carrying the victim girl with him. The petitioner has no concern with the victim girl and he had been going to Kosi barrage for domestic work and has been arrested in this case merely on suspicion. He further submits that the victim girl has not levelled any allegation against the petitioner for committing any bad act with her. The petitioner neither put the victim for immoral trafficking nor the victim has levelled any allegation against the petitioner.
He further submits that the victim girl was a major aged about 18 years and she herself left the house and went outside with her lover and petitioner was roped in this case merely on the basis of suspicion. Learned counsel next submits that petitioner is having clean antecedent and chargesheet has been submitted in this case. Learned counsel lastly submits that petitioner is in custody since 17.05.2025.
5. Learned A.P.P. appearing on behalf of the State opposes the submission made on behalf of the petitioner.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the fact the voluntary nature of act of the victim girl and petitioner's

No.57998 of 2025(2) dt.27-08-2025 3/3 clean antecedent, submission of chargesheet against him and further considering his period of custody, the petitioner, abovenamed, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Birpur, Supaul / concerned Court, in connection with Bhimnagar P.S. Case No. 32 of 2025, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial Court.
(iii) In case of non-appearance of the petitioner on single date or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned.
