ANJANA MISHRA ORAL ORDER 10-09-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 341/ 409/420/504/120(B) of the Indian Penal Code.

Learned counsel for the petitioners submits that the present case has been filed by the principal of a college alleging that these petitioners misappropriated money which they had received by way of fees and forms of students of the college. He submits that on the date of lodging of the First Information Report, the concerned principal had already been removed from the post on 06.10.2012 and it is only to feed fat some grudge between the management of the college and himself the present case has been

Patna High Court Cr.Misc. No.17343 of 2015 (4) dt.10-09-2015 P2/2 lodged implicating these petitioners who have duly deposited the money received by them in the bank account of the college and university.

Considering the nature of allegations made against the petitioners and the receipts which have been brought on record, let the petitioners abovenamed , in the event of their arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Shambhuganj P.S. Case No. 140 of 2012 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
