JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioner seeks bail in connection with Banshi P.S.Case No. 05 of 2017 registered under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.
Earlier prayer for anticipatory bail of the petitioner was disposed of vide order dated 25.04.2018 passed in Cr. Misc. No. 16819 of 2017 with direction to surrender before the court below and makes prayer for regular bail which will be considered by the court below on the basis of allegation made against her and also considering that the petitioner is a lady. Submission of learned counsel for the petitioner is that petitioner could not surrender due to illness. Heard learned APP also.
It appears that order was passed on 24.04.2017 and after about one and half year, second anticipatory bail
Patna High Court Cr.Misc. No.75934 of 2018(2) dt.20-12-2018 2/2 application has been filed and the reason assigned is not satisfactory . In such view of the matter, I am not inclined to interfere with the earlier order passed by this Court. However, if petitioner surrenders and makes prayer for regular bail, the same shall be considered on its own merit without being prejudiced by this order.
