2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 498(A), 304(B),34 of the Indian Penal Code and section 3/4 of the DP Act.
3. It is a case of cruelty and dowry death due to nonfulfillment of additional dowry demand of Rs. 5 lac.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is husband of the deceased and has been falsely implicated in this case. He has never demanded any thing from the deceased or her family members. In fact, deceased herself committed suicide by hanging. No external injury was found over the body of the
Patna High Court CR. MISC. No.56776 of 2023(4) dt.29-01-2024 2/2 deceased. No consistent evidence has come against the petitioner to show his complicity in the present case. He has got no criminal antecedent and languishing in judicial custody since 15.10.2022.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II, Rosera, Samastipur in connection with S.T. No. 421 of 2023, Bibhutipur PS Case No. 376 of 2022. (Sunil Kumar Panwar, J) sushma/- U
