The petitioner has been made accused in Sahebganj P.S. Case No.185 of 2014 dated 23rd June, 2014 which was initially registered for the offences punishable under sections 147, 148, 149, 341, 323, 324, 307, 379, 504 and 120B of the Indian Penal Code but in course of investigation section 302 of the Indian Penal Code has also been added in the FIR.
A bare perusal of the FIR makes it clear that the
Patna High Court Cr. WJC No.1241 of 2014 (2) dt.05-01-2015 allegation made in the written report submitted by the informant on the basis of which formal FIR was drawn do constitute a cognizable offence.
In that view of the matter, I find no merit in the present writ petition. Accordingly, the writ petition is dismissed. (Ashwani Kumar Singh, J) Md.S./- U T
