This is an application for regular bail in connection with Bihpur P. S. Case No. 353 of 2017 registered for the offences punishable under Sections 147, 148, 149, 302 and 3379 of the Indian Penal Code.

It has been submitted by learned counsel for the petitioner that similarly situated co-accused Sunil Singh has already been granted bail vide order dated 11.01.2018 in Cr. Misc. no. 59253 of 2017. In the order granting bail it has been observed that after going through the case diary it appears that the deceased was a veteran criminal and due to some rivalry with another criminal, who was unfortunately brother of this petitioner, for claim over a looted rifle, murder of the deceased was committed by some unknown persons. Patna High Court Cr.Misc. No.60851 of 2017(2) dt.17-01-2018 2/2 no way involved in this crime. Petitioner bears clean criminal history. He is in custody since 30.08.2017.

Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned ACJM,Naugachia, ( Bhagalpur) in connection with Bihpur P. S. Case no. 353 of 2017.
