The petitioner is seeking anticipatory bail in connection with Tiyar P.S. Case No. 68 of 2018 registered under Sections 414 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is a student having no criminal antecedent. The motorcycle in question is said to have been recovered near the house of the petitioner. It is thus submitted that the said motorcycle had not been in conscious possession of this petitioner and petitioner has been falsely implicated in this case. It is submitted that petitioner has no criminal antecedent. In the given facts and circumstances of the case, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged
Patna High Court Cr.Misc. No.75230 of 2018(2) dt.20-12-2018 2/2 on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate - 1st Class, Ara, Bhojpur, in connection with Tiyar P.S. Case No. 68/2018, subject to condition that petitioner shall join investigation by reporting to the Investigating Officer within a period of three weeks from today and shall cooperate in course of investigation, failing which the Investigating Officer shall be at liberty to take steps for cancellation of bail. This will be in addition to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
