The present petition has been filed with a prayer to restore C.W.J.C. No. 13236 of 2000 which stood dismissed against the respondent no. 5 due to non -compliance of peremptory order dated 12.2.2008.

After hearing learned counsel for the parties and considering the grounds set forth in the petition particularly the statement made in paragraph no. 3 of the petition, same is allowed.

Let C.W.J.C. No. 13236 of 2000 be restored to its original file as against the respondent no. 5. It is clarified that earlier order dated 12.2.2008 passed in C.W.J.C. No. 13236 of 2000 must be complied within a period

Patna High Court MJC No.4077 of 2014 (3) dt.04-02-2017 2/2 of four weeks from today failing which the writ petition i.e. C.W.J.C. No. 13236 of 2000 shall stand dismissed against respondent no. 5 again.
