This application is for grant of regular bail in connection with Nokha P.S.Case No.97 of 2017 for the offences punishable under Sections 120(B) of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act.
Allegation against the petitioner is as per FIR is that the police raided on information that the accused persons are preparing for dacoity and arrested some accused persons but the petitioner succeeded in fleeing away from the place of occurrence. It further appears that the petitioner is accused in 11 other cases of similar nature.
Submission of the learned counsel for the petitioner is that the FIR itself shows that he was not arrested and nothing
Patna High Court Cr.Misc. No.53184 of 2017 (2) dt.21-11-2017 2/2 has been recovered from his possession though he is accused in several other cases but he is on bail in those cases. Now he is in custody since 18.5.2017.
Heard learned A.P.P. also.
Having heard both sides and in view of considering criminal antecedent of the petitioner, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of nine months.
With the aforesaid direction, this application is disposed of.
