Mr. Sri Sanjay Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 19-12-2018 Heard learned counsel for the petitioners as well as learned counsel for the State.

Petitioners apprehends arrest in a case registered for offence under sections504, 506, 457, 380/34 of the Indian Penal Code and under section 27 of the Arms Act.

It is submitted on behalf of the petitioners that due to some personal enmity between the parties case has been instituted to falsely implicate the petitioners. Four days prior to the FIR lodged against the petitioners, one Azimabad Police Station Case No. 37/2018 has been lodged by the petitioner no.1 wherein similar allegation has been made. There is a case and counter case. Prior to the instant case, there is no criminal antecedent of the petitioners.

Considering the aforesaid submissions and the facts

Patna High Court Cr.Misc. No.74870 of 2018(2) dt.19-12-2018 2/2 and circumstances of the case, prayer for bail to both the petitioners is allowed. In the event of arrest/surrender within four weeks from today, let both the petitioners as mentioned above be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of ACJM VIII, Ara (Bhojpur) in Azimabad Police Station Case No. 38 of 2018 on the following conditions:- One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how they are related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners and The Petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
