1. Heard learned counsel for the petitioner and learned A.P.P. for the State along with learned counsel for the O.P. No.2.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 366 and 376 of the Indian Penal Code.

3. Learned counsel for the O.P. No.2 at the outset submits that he has instructions to make submission that based on wrong identification, the petitioner came to be implicated in the instant case, when he is not the owner of mobile no. 7765882613, as such, the informant has given instruction not to oppose the anticipatory bail application and has even entered into a compromise with the petitioner.

4. Considering the submissions made by the learned counsel for the O.P. No.2, the petitioner above-named, in the

Patna High Court CR. MISC. No.60221 of 2023(5) dt.08-04-2024 2/2 event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Araria PS. Case No.408/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
