JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in a case registered for the offences punishable under sections 341, 323, 324, 307, 498A of the Indian Penal Code.
Although, petitioner is named in the first information report but allegation of assault has been levelled not only against the petitioner but several other F.I.R named accused as well as unknown persons. Annexure-3 of the petition goes to show that the informant sustained only two injuries that are, too, simple in nature. The first information report further goes to show that the petitioner is brother -in-law of informant's
Patna High Court Cr.Misc. No.76500 of 2018(2) dt.21-12-2018 2/2 sister and the relation of informant's sister with her husband was not cordial at the time of alleged occurrence. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Darbhanga in connection with Pator O.P ( Ashok paper Mill) P.S.Case No. 71 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C.
