1. Learned counsel for the petitioner submits that P.D.S. license of the petitioner was cancelled by the licensing authority i.e. Sub Divisional Officer, Phulparas, Madhubani by order dated 31.07.2020. The petitioner approached this Court in CWJC No. 8678 / 2020 (Annexure P-6) challenging the order of cancellation and this Court vide order dated 25.11.2021 directed the petitioner to approach the appellate authority i.e. District Magistrate, Madhubani. The petitioner filed an appeal before the appellate authority who by its order dated 15.05.2023

Patna High Court CWJC No.13154 of 2025(2) dt.02-12-2025 2/2 remanded the matter back before the licensing authority i.e. Sub Divisional Officer, Phulparas, Madhubani but since 2023 the matter is pending before the S.D.O., Phulparas, Madhubani and he is not taking any action on the application for the last two years.

2. Considering the nature of prayer made in the writ application, the Sub Divisional Officer, Phulparas, Madhubani is directed to dispose the application / case of the petitioner on remand within three months from the date of receipt / production of a copy of this order after giving adequate opportunity of hearing to all concerned including the petitioner.

3. With the aforesaid observation and direction, this writ application is disposed of.
