Let the petitioner surrender and pray for regular bail before J. M. Ist Class, Rosera, District-Samastipur in connection with Bibhutipur P.S.Case No.175 of 2014. The court below shall if it finds so advisable to it, seek the production of the injury report of Ram Balak Mahto in its original along with the final opinion which could have been rendered as regards injuries recorded upon him by the doctor of Primary Health Centre, Bibhutipur who had treated the said injured on police requisition in the above noted case. The court below shall not be prejudiced by the fact that the petitioner had moved this Court also under Section 438 Cr.P.C. and if need be it may be within its right to admit the petitioner to provisional bail till the original copy of the
Patna High Court Cr.Misc. No.17203 of 2015 (2) dt.30-07-2015 injury report was produced before it but in no case, the matter shall be prolonged beyond a period of three weeks from the date of surrender of the present petitioner.
