JUSTICE SATYAVRAT VERMA ORAL ORDER 05-02-2025 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned Counsel, Mr. Brij Bihari Tiwary appearing on behalf of the Department of Mines.
2. The petitioner apprehends his arrest in connection with Obra P.S. Case No. 206 of 2021 registered for the offences punishable under Sections 379, 411 and 420 of the Indian Penal Code.
3. The learned APP, at the outset, submits that the offences for which the instant FIR has been instituted carries punishment of seven years and less. The said submission of the learned APP is not disputed by the learned Counsel appearing on behalf of the petitioner and the Department of Mines. The learned Counsel appearing on behalf of the petitioner submits

No.72387 of 2024(2) dt.05-02-2025 2/2 that the investigation in the case against the petitioner is still continuing, but then the notice under Section 41A of the Cr.P.C. has not been given to the petitioner, on which the learned APP submits that the case be disposed of in terms of order dated 13.02.2024 in Cr. Misc. No. 3536 of 2024 in Naushad Ansari V. The State of Bihar.
4. In view of the submissions made by the learned APP, the anticipatory bail application is disposed of in terms of the order dated 13.02.2024 passed in Cr. Misc. No. 3536 of 2024.
5. The petitioner would be at liberty to file a representation before the concerned Superintendent of Police and the Investigating Officer of the case within a period of three weeks from today with a web copy of the order dated 13.02.2024 passed in Cr. Misc. No. 3536 of 2024 and the concerned Superintendent of Police shall ensure that the Investigating Officer of the case strictly adheres to the direction contained in the said order dated 13.02.2024 passed in Cr. Misc. No. 3536 of 2024.
