JUSTICE RAKESH KUMAR ORAL ORDER 01-12-2016 After some argument, Sri Ranjeet Kumar Singh, learned counsel for the petitioners, in presence of Sri Anand Kishore Choudhary, learned Addl. Public Prosecutor as well as Sri Shailendra Kumar Jha, learned counsel, who has appeared on behalf of the informant, seeks permission to withdraw this petition, so that the petitioners may appear before the court below and make a prayer for regular bail.
The prayer is allowed.
The petition stands dismissed as withdrawn with indication that if within six weeks from today the petitioners appear before the court below and make a prayer for regular bail,
Patna High Court Cr.Misc. No.38471 of 2016 (3) dt.01-12-2016 2/2 the learned court below without being prejudiced with this order may examine the same and pass appropriate order in accordance with law preferably on the same day.
In view of dismissal of the present petition, interim order dated 19.09.2016, whereby the petitioners were granted provisional anticipatory bail, stands vacated. Meaning thereby that their bail bond executed in the case stands cancelled. (Rakesh Kumar, J) NKS/- U T
