The petitioner, already in custody, seeks bail in connection with Mahisi P.S.Case No. 160 of 2015 registered under Sections 366A and 376 of the Indian penal Code and Section 4 of the Protection of Children from Sexual Offences Act, Allegation in brief is that petitioner, with the help of two other accomplices, kidnapped the minor daughter of the informant and committed rape during captivity. Learned counsel for the petitioner submits that one of the co-accused has been put on trial and acquitted as the witnesses have not supported the case and the petitioner is in custody since 14.09.2017, however there is no specific allegation against him
Patna High Court Cr.Misc. No.60880 of 2017 (2) dt.19-12-2017 2/2 and his case stands on better footing to others. However, specific allegation of kidnapping and committing rape to minor girl is against the petitioner, so his prayer for bail is rejected at this stage.
Trial court is directed to expedite the trial and conclude the same preferably within a year.
