JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-03-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 3.5.2017 passed in Cr.Misc.No. 19514 of 2017 on merit as there was recovery of 75 kg. of ganja. Submission of learned counsel for the petitioner is that petitioner is in custody for the last 20 months and till date trial has not commenced.

Heard learned APP also and perused the report from which it appears that earlier two accused persons were absconding and, as such, trial of both accused persons was separated vide order dated 4.1.2018.

Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner. Hence, prayer for bail is rejected.

At the same time, Senior Superintendent of Police, Gaya is directed to ensure the presence of the witnesses in court on the date fixed, so that the trial is concluded within a period of further two months.
