The petitioner seeks bail in anticipation of her arrest in connection with Jogbani P.S. Case No. 19 of 2018 dated 25.01.2018 instituted for the offences under Sections 25(1-b)a/26/35 of the Arms Act.

The house of the husband of the petitioner was raided because of his being an accused in a case instituted for the offence under Section 395 of the IPC. In the absence of any female member in the raiding team, the police party alleges to have recovered a bag containing two loaded pistols, one out of which was made in USA. A seizure list was prepared which indicates/affirms that the petitioner was not present at the place of raid. The petitioner is being prosecuted in

Patna High Court Cr.Misc. No.72645 of 2018(2) dt.20-12-2018 2/2 this case only on the ground that her husband is an accused in the present case as well as in another case for which raid was conducted in the house where petitioner also resides as the wife of aforesaid Manoj Yadav.

The petitioner does not have any criminal antecedent. The husband of the petitioner viz. Manoj Yadav has surrender to the process of law and has been granted bail.

Considering the aforesaid facts, the petitioner above named is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on her furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Jogbani P.S. Case No. 19 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
