Petitioner seeks regular bail in connection with Gwalpara P.S.Case No.135 of 2017 instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Act,2016. The allegation is regarding recovery of 4 litres of illicit country made wine from the possession of the petitioner. The learned counsel for the petitioner submits that no recovery has been affected from the conscious possession of the petitioner. It is further submitted that the petitioner is having a clean antecedent languishing in jail custody since 04.10.2017.
