02. 26.09.2016 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 379 and 504 of the Indian Penal Code. It is contended on behalf of the petitioners that due to land dispute the scuffle took place between the parties in which they were brutally assaulted on account of which the petitioner no. 5 registered the FIR being Tarabari P.S. Case No. 52 of 2016 thereafter the Informant also got registered the present FIR and

Patna High Court Cr.Misc. No.38093 of 2016 (2) dt.26-09-2016 except one grievous injury on one of the accused persons all injuries are simple in nature and injuries are on both sides. The allegation of assault is general and omnibus in nature. Having regard to the facts and circumstances of the case, let the petitioners, namely, Raj Kumar Mandal, Pramod Kumar Mandal, Bhim Nath Mandal, Runia Devi, Dropadi Devi and Sanju Devi be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Tarabari P.S. Case No. 53/2016, on furnishing bail bonds of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Sri R. Narayan, Additional Chief Judicial Magistrate-III, Araria or his successor subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
