JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2019 This application, for grant of anticipatory bail, arises out of Sheosagar P.S. Case No. 148 of 2018, disclosing offences under Sections 323, 341, 379 and 498A of the Indian Penal Code.

Petitioner happens to be husband of the informant and allegation against the petitioner is of cruelty and torture to the informant and the petitioner also snatched away ornaments of the informant worth Rs. Three lakhs.

Submission of learned counsel for the petitioner is that the marriage of the petitioner with the informant was solemnized 50n years ago, the petitioner is aged about 65 years and has falsely been made accused in this case and no such occurrence has ever taken place.

Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sheosagar P.S. Case No. 148 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
