Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sonpur P.S. Case No. 411 of 2022, lodged under Sections 302/34 of the Indian Penal Code.

As per prosecution case, the informant had disclosed that in the early morning she went for teaching, when she returned at 13.30 then saw that door was opened and her mother is not present, subsequently when she reached near Chapakal then saw that the neck of her mother has cut by sharp weapon and pole of blood is there. Thereafter she has

Patna High Court CR. MISC. No.55648 of 2022(2) dt.21-02-2023 2/3 filed the present F.I.R. against 2 accused persons showing that they have earlier threatened to her mother. In this regard she had complaint to the family members of the accused but they have threatened and as such she has strong suspicion that both the accused persons named in the F.I.R. have brutally killed her mother.

Learned counsel for the petitioner submits that antecedent of petitioner is clean and only on the basis of suspicion the present F.I.R. has been lodged. There is no eye witness in this case, which transpires from the F.I.R. itself. Learned counsel for the petitioner further submits that petitioner is in custody since 08.07.2022, charge sheet has already been filed.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra in connection with Sonpur P.S. Case No. 411 of 2022, subject to the conditions as laid down under Section
