2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 366A of the Indian Penal Code.
3. The case of the prosecution is that informant who is the mother of the victim has stated that her minor daughter has been taken away by one Vivek Kumar and she was boarded on Sanghmitra train and after that informant came to know about this from one Sapna Kumari. It is stated that two girls were boarded on that train, namely, Sapra and Riya. Sapna Kumar alighted at Buxar station and she told the informant that her daughter has also gone on that train.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. During course of investigation, victim has given her statement recorded under Section 164 of the Cr.P.C. and from perusal of her statement, it is clear that she has stated that she liked Abhishek and this petitioner has got a kissing photo of the victim and Abhishek and on that pretext, this petitioner used to torture her showing this photograph. Abhishek has gone to Bangalore and this petitioner used to tell her to go to Bangalore and also threatened to show her photograph to her father. It has further been stated by the victim that on 04.01.2024 Abhishek has come to fetch her and from school by tempo she went to Dighwara and from there she went to Bangalore.
Only allegation against this petitioner is that he used to torture the victim and threatened her to see her photograph to her father. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 26.03.2024.
5. Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Dighwara P.S. Case No. 8 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IInd, Saran at Chapra.
