2. The petitioners apprehend their arrest in connection with Saraiya P.S. Case No. 433 of 2018, instituted under Sections 272 and 273 of the Indian Penal Code and Sections 37(d), 30(a), 38 and 41 of the Bihar Prohibition & Excise Act.
3. There is recovery of 50 litre country made liquor from the house of co-accused Sanjeet Sahani. Allegation against the petitioners is that they are also involved in selling of illicit liquor with the co-accused.
4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. Nothing has been recovered from conscious possession of
Patna High Court CR. MISC. No.55902 of 2025(2) dt.02-09-2025 2/2 the petitioners. Petitioners have neither concern with the seized liquor nor with the place of occurrence. Except suspicion, there is no material against the petitioners. Petitioners have no criminal antecedent. They undertakes to co-operate in the investigation and trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners, above-named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court No. II, Muzaffarpur in connection with Saraiya P.S. Case No. 433 of 2018, subject to the conditions laid down in Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
