For the Petitioner/s : Mr. Maruth Nath Roy, Advocate For the Respondent/s : Mr. Binod Ji Verma, GP-17 ====================================================== CORAM: HONOURABLE MR. JUSTICE JYOTI SARAN ORAL ORDER 21-07-2015 Although the petitioner seeks to question the orders passed by the Collector, Gopalganj in Money Lender Appeal No. 1 of 1999 dated 20.6.2014 affirming the order passed by the D.C.L.R., Gopalganj dated 26.6.1999 / 29.6.1999 in Money Lending Case No. 62 of 1998-99 inter alia on grounds that the land in question having already been redeemed there was no occasion for the statutory authorities to pass a second order of reversion of the property relying upon some documents but when the matter is taken up for consideration Mr. S. Paras Mani prays for disposal of the writ petition seeking liberty for the petitioner to espouse his grievance by filing an appropriate application before the appropriate forum.
Patna High Court CWJC No.38 of 2015 (4) dt.21-07-2015 In my opinion, the issues raised by the petitioner in this application in no manner would affect the exercise undertaken by the statutory authorities under the Money Lenders Act warranting any interference. Insofar as the claim put forth by the petitioner on the basis of purchase is concerned, he shall be at liberty to take recourse to such other remedy that may be available to him in law. The writ petition is disposed of accordingly. (Jyoti Saran, J) S.Sb/- U
